El objetivo del artículo es describir la fenomenología jurídica de Adolf Reinach, apuntar algunos posibles desarrollos de la misma y esclarecer su contribución a la filosofía del derecho contemporánea. En primer lugar, se traza una breve biografía intelectual de su autor, para pasar, tras un breve análisis de su obra sobre La Premeditación, al análisis de la teoría de los actos sociales y la exposición de la necesidad y posibilidad de una ciencia jurídica cuyas proposiciones sean sintéticas y a priori. (...) Por último, se analiza la relación de esta ciencia que describe los estados de cosas jurídicos, con la ciencia jurídica empírica y las disposiciones del derecho positivo. This article is a review and reflection of the new elements of rights and laws, applied to the principle of justice and sovereignty, but above all in the demonstration that law as a science once again allows us to conceive that as a science it evolves and must be modified according to the new conducts that the State and society require, such is the case of the constitutional recognition that this type of rights have. In the last decades, human beings (...) have evidenced that the way in which they interact with nature is causing serious consequences to the ecosystems that compose it. In the past, these consequences were not yet evident and, therefore, the environmental awareness that exists today did not exist. En la historia intelectual de América Latina existe una laguna respecto a la producción de las mujeres en el género de ensayo. Son los ensayos de identidad criolla, de hechura masculina, los que construyen el canon respecto a las temáticas y a las maneras de ser abordado. Los ensayos de género que las escritoras han realizado se articulan como respuesta a esta visión dominante de los procesos sociales, políticos y culturales de los países latinoamericanos. Revelan un fuerte descontento con la (...) construcción de la identidad femenina, una preocupación por la construcción de una ciudadanía plena y representan una respuesta a las demandas sociales políticas y culturales de las mujeres y otros grupos marginales. Las intelectuales debatieron, discutieron y polemizaron con las propuestas que al respecto portaban los discursos dominantes y el ensayo de género se vuelve el “arma de combate”. Lo que aquí se presenta, tiene como objetivo la recuperación de este corpus de conocimiento en la historia literaria de Cuba, Puerto Rico y República Dominicana. Una labor de arqueología literaria de temas, obras y autoras a partir del siglo XX. Se brinda, a partir del libro Mujeres ensayistas del Caribe Hispano: Hilvanando el silencio (2007) deAnna Freire Ashbaugh, Lourdes Rojas y Raquel Romeu, una visión panorámica del conjunto de ensayistas de cada país. The non-adaptationist approach to evolutionary epistemology was born at the end of the 1970s as an alternative to traditional adaptationist EE. Despite the fact that non-adaptationist EE offers compelling interpretative models and its explanatory power is widely recognised, an organic overview of the broad non-adaptationist field is still lacking. In this paper, I propose to fill this gap. To this effect, after providing a systematisation of the perspectives that are commonly associated with non-adaptationist EE, I will discuss two recurring orders (...) of arguments that non-adaptationist scholars, often independently of one another, put forward against their adaptationist rivals. By offering a way to conceive non-adaptationist evolutionary epistemological approaches as part of a structured whole, the resulting systematic account is meant to provide a reading grid, a compass for orienting oneself in the uneven territories of non-adaptationist EE. Moreover, the consequent identification of two recurring argumentative bodies is intended to add to the explanatory power of non-adaptationist EE, which in finding new strength in numbers eventually acquires a greater critical efficacy against its adaptationist counterpart. This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. This study sheds new light on why healthcare organisations are having difficulty responding to the growing pressure from stakeholders to proactively address their responsibility to deliver high-quality services without harming the environment. Basing our work on past research on stakeholder pressure and environmental barriers, we conceptualise and empirically test the effect of the interplay between stakeholder pressure and internal barriers on healthcare organisations’ adoption of proactive environmental strategies. To test the proposed hypotheses, a survey was carried out among medical directors (...) of Italian healthcare organisations in 2012. Our results show that the lack of commitment to environmental issues within the organisation represents the main barrier to healthcare organisations’ implementing PESs. Furthermore, the difficulties in evaluating the impacts of advanced environmental practices negatively moderate the influence of stakeholders on developing PESs. Our findings contribute to extending previous knowledge on PESs in two ways: focusing on the healthcare sector, our study investigates the phenomenon in a research context that has been largely overlooked in the sustainability literature; and cross-cutting previous research on stakeholder pressure and internal barriers, the study conceptualises and tests a more complete framework for understanding the adoption of PESs. This article identifies a disciplinary disconnection between secular and religious feminisms. While areas of study such as women’s, gender and feminist studies, and disciplines like feminist studies in religion, spirituality and theology advance understanding of gender relations, they are forms of analysis that rarely keep company. As we argue, there is a disconnection grounded in a sacred/secular divide evident through the different stages of the women’s movement and feminist history. Not only is this disciplinary disconnection mutually unhelpful, but it has (...) implications for the ways gendered religious and secular discourses operate in the public square and therefore, has implications for the future of feminist theology. This article first identifies the lack of relationship between secular and religious feminisms illustrated in three interrelated ways: secular feminisms’ neglect of women’s religious experiences; feminist religious studies’ reservedness; and the sacred/secular binary operating in the academy. We then suggest this disconnection extends to the most recent expressions of feminism – the third wave. This article then discusses what both disciplines lose from a lack of dialogue and what might be gained by a closer relationship; particularly when contemporary events in the public sphere highlight the importance of paying attention to the way women’s experiences, and secular and religious discourses interact. Gottlob Frege rozlišuje mezi smyslem a významem výrazů, přičemž smyslem rozumí to, co je výrazem vyjadřováno, významem pak to, co je jím označováno. Toto rozlišení se týká jak singulárních, tak obecných výrazů, ovšem Fregovy rozbory týkající se významu obecných výrazů jsou všeobecně méně známy. Chci zdůraznit skutečnost, že Frege považuje za význam obecných výrazů pojem, který chápe jako tzv. nenasycenou funkci, nikoli jako množinu nebo zobrazení. To mu umožňuje zachovat některé podstatné intuice týkající se obecnin – můžeme např. mít obecný (...) pojem (znát nějakou vlastnost či relaci), aniž bychom věděli, jaké předměty pod něj spadají. Zároveň se snažím ukázat, že není jasné, nakolik Frege skutečně zastával tezi, která mu bývá obvykle přičítána, totiž že identita pojmů je dána jejich koextenzivitou. Gottlob Frege distinguished between sense and reference of expressions. 'Sense' according to him is that what the expression means, 'reference' is that what is designated by it. This distinction concerns both singular and general terms but Frege’s analyses focused on general terms are much less known. It is crucial, I argue, to appreciate the importance of the fact that the reference of a general term is, according to Frege, a concept – identified with an unsaturated function in the Fregean sense, i.e. not a set, and not a mapping. In this way Frege can keep some important intuitions about universals – for instance that we can have a general concept (know a property or a relation) even if we don’t know which objects fall under it. I also try to show that it is not clear whether Frege really defended the thesis usually attributed to him that the identity of concepts is guaranteed solely by their coextensivity. (shrink)

This article examines the production of consecrated femininity in contemporary Polish convents. Drawing on qualitative data from 35 interviews in five religious communities the article explores the type of female agency which transforms the dominant model of Polish femininity instead of resisting it. Following Lois McNay’s concept of narrative identity, the article argues that female agency does not necessarily emerge out of subversion of the male-dominated Polish Catholic Church. Rather than simply being placed within discursive structures, Catholic nuns reflexively alter (...) them by using a mixture of gender ideology and spiritually driven gender work in order to produce coherent and socially meaningful narratives of consecrated femininity. He is well-known for applying the idea of critical reason to various kinds of human practice, including economics, politics, and law. But he has also improved on Popper's methodology by introducing the idea of rational heuristics. This collection of essays presents the core of his work on epistemology, philosophy of the social sciences, philosophy of religion, and philosophy of law. El enfoque de las capacidades (EC) defendido por ella pretende ser una alternativa a las modernas teorías del contrato. Para Nussbaum, dignidad, capacidades humanas y recursos materiales son indesligables. Del mismo modo, la perspectiva cosmopolita es una exigencia inexcusable en la teoría de la justicia de Nussbaum. En este artículo tratamos de rastrear (...) los distintos ingredientes de esta, sus raíces en el cosmopolitismo estoico, y también su discusión con él para afrontar los desafíos que plantea la justicia global en el presente, con una perspectiva de futuro. INDIAN THOUGHT AND ITS DEVELOPMENT by ALBERT SCHWEITZER.Originally printed in 1936. PREFACE: I HAVE written this short account of Indian Thought and its Development in the hope that it may help people in Europe to become better ac quainted than they are at present with the ideas it stands for and the great personalities in whom these ideas are embodied. To gain an insight into Indian thought, and to analyse it and discuss our differences, must necessarily make European thought (...) clearer and richer. If we really want to understand the thought of India we must get clear about the problems it has to face and how it deals with them. What we have to do is to set forth and explain the process of develop ment it has passed through from the time of the Vedic hymns down to the present day. I am fully conscious of the difficulty of describing definite lines of development in a philosophy which possesses in so remarkable a degree the will and the ability not to perceive contrasts as such, and allows ideas of heterogeneous character to subsist side by side and even brings them into connection with each other. But I believe that we, the people of the West, shall only rightly comprehend what Indian thought really is and what is its significance for the thought of all mankind, if we succeed in gaining an insight into its processes. Like every European who studies Indian philo sophy, I am deeply indebted to the scholars who have published the texts and been responsible for the fundamental work of research. I am specially grateful to Professor Moriz Winternitz of Prague, not only for what I have learnt from his great work on Indian Literature, but also because he has allowed me a share in the wealth of his knowledge by giving me a fund of information in response to my questions. My attention was drawn to Indian thought because it is busied with this problem and because by its nature it is mysticism. What I liked about it also was that Indian ethics are concerned with the be haviour of man to all living beings and not merely with his attitude to his fellow-man and to human society. But the closer my acquaintance with the docu ments of Indian thought the more I was assailed by doubts as to whether the view made familiar to us Europeans by the works of Arthur Schopenhauer, Paul Deussen and others the view namely that Preface vii Indian thought is completely governed by the idea of world and life negation is right. I was compelled to admit the fact that world and life affirmation is present at the back of this thought from the very dawn of its history, and that the existence and inter fusion within it of world and life negation and world and life affirmation constitute its special character istic and determine its development. Questo articolo si inserisce nell’ambito dei più recenti studi baconiani che hanno determinato una revisione critica della fortuna di Francis Bacon , la pubblicazione di nuove opere o parti di opere inedite e uno studio attento del lessico e del vocabolario baconiano. Per quanto riguarda la seconda metà del ‘700 e l’‘800, la fortuna e l’incidenza del pensiero baconiano è quasi tutta da studiare, schiacciata com’è dal giudizio moralistico sulla sua ‘caduta’ . In merito alla fortuna di Francis Bacon in (...) Italia nel XVIII e XIX secolo ho analizzato due dei possibili autori che alle opere del filosofo inglese diedero attenzione: Cesare Beccaria e Vincenzo Gioberti. (shrink)
